("T-Data S.r.l.") through this website, but it has not been possible to resolve the dispute that is the subject of your complaint, T-Data S.r.l. will provide you with information on the Alternative Dispute Resolution body or bodies for out-of-court settlement of disputes (so-called ADR bodies, as indicated in articles 141-bis et seq. of the Consumer Code), specifying whether or not it uses such bodies to resolve the dispute

 

Furthermore, we remind you that a European platform for the online resolution of consumer disputes has been set up (the so-called ODR platform). The ODR platform can be consulted at http://ec.europa.eu/consumers/odr/; through the ODR platform you can consult the list of ADR entities, find the link to the site of each of them and start an online dispute resolution procedure for the dispute you are involved in.

 

According to art. 49 c. 1 lett. v) of Legislative Decree no. 206/2005 (Consumer Code), the customer who wishes to resolve a dispute arising with the merchant (i.e. T-Data S.r.l.) may use the Joint Conciliation Procedure. The Procedure may be initiated if the consumer, after having submitted a complaint to the company, has not received a reply or has received a reply that he/she is not satisfied with within 45 days. For any cross-border disputes relating to the application, execution and interpretation of the General Terms and Conditions of Sale of T-Data S.r.l. governing purchases through this site, if you are a resident or domiciled in a member state of the European Union other than Italy, you may bring the European Small Claims Procedure established by Regulation (EC) no. 861/2007 of 11 July 2007 before the competent court, provided that the value of the claim does not exceed, excluding interest, fees and expenses, EUR 5,000.00 on the date the competent court receives the claim form.

In any event, whatever the outcome of the out-of-court settlement of the dispute, your rights to go to ordinary courts and, if the conditions are met, to initiate an out-of-court settlement of disputes relating to consumer relations through recourse to the procedures set out in Part V, Title II-bis of the Consumer Code are unaffected.
